Rescission of Court Order
This process is recommended based on the fact that a court order was granted forming part of your debt review. In terms of the NCA a court order is an enforcement of compliance with the resctructured repayment arrangement between the consumers and credit providers. Normally there is no need to rescind the court order as it clearly states that the consumer must be issued with a clearance certificate once the debts are paid in full or the consumer can display that they will be able to fullfil the repayment of the outstanding accounts. rescission of the court order mainly depends on the wording of the order.
Affidavit for Rescission of Court Order
For any court appication, an affidavit is required where the facts are presented to the court that granted the order to consider the circumstances underwhich the application is made.
The affidavit is the crucial part of the application and should be drafted by a legal practitioner and duly commissioned by the commissioner of oaths.
Our in-house legal practitioner charges a once-off fee of R950 for the drafting of the affidavit. Once payment of the fee is confirmed, you will receive the affidavit to commission at your nearest police station.
