The ADRDS System was developed by NCR-trained and certified professionals to provide consumers with a clear, reliable process to dispute unlawfully placed or unfairly retained debt review flags.

With direct access to the NCR, the ADRDS system ensures your case is handled with expertise and transparency, keeping you up to date with your dispute progress.

In terms of Section 136 of the National Credit Act (NCA), the NCR is obliged to investigate the dispute and where any non-compliance issues are established, resolve the matter and remove the debt review flag within 7 - 30 days.

INTRODUCING THE ALTERNATIVE DEBT REVIEW AFTER-CARE SERVICE

The Problem:
Since the inception of Debt Counselling in 2007, 4513 debt counsellors were registered and accredited by the NCR. As at December 2023, over 3000 are no longer involved in the debt counselling practice for various reasons. This has left thousands of consumers with a permanent debt review flag without a debt counsellor to render the mandatory after-care service and the ultimate removal of the debt review flag. Without a debt counsellor to monitor your debt review progress, you are indefinitely stuck with a debt review flag on your credit record even when your debts have been paid in full and your financial circumstance have improved.

Obligatory Debt Review After-Care:
NCR accredited Debt Counsellors are obliged to render mandatory after-care services (listed below) for the consumers that they placed under debt review. The consumer is paying R460 per month for the after-care service for the duration of the debt review term. This fee is included in your restructured monthly debt repayment.

Review of the consumers’ financial situation
Attend to any payment queries
Attend to the clearance process which includes securing paid up letters
Attend to the 17. W process. (withdrawal from debt counselling by the consumer)
Attending to the update of the NCR debt help system
Issue Clearance Certificate

The Solution:
In terms of the NCA Section 136 Regulation 56, a consumer can appoint a third party to log a dispute and/or enforce their rights under the debt review system. Where the debt counsellor is not available or neglects the mandatory after-care obligations, the third party can undertake the after-care role and/or log a complaint with the NCR to enforce the after-care obligations 

The NCRA has launched an Alternative Debt Review After-Care Service to accommodate the abandoned consumers to ensure that they are released from debt review as and when they become eligible.
The after-care service includes dispute and removal of the debt review flag for consumers who have been unlawfully placed or are stuck under debt review.

How does Alternative After-Care Service Work?

In the event that you paid or you are still paying your accounts through the appointed PDA, we liase with the PDA to supply distribution statements 

Issuance of Clearance Certificate

In the event that you have settled all accounts that were placed under debt review, we can either contact the debt counsellor to issue a clearance certificate or liaise with the NCR to enforce issuance a the clearance certificate. In this instance you will need to supply settlement confirmation letters. In case you cannot get the settlement letters, we shall contact all your credit providers on your behalf to supply same.

Settlement of Outstanding Accounts

As an Alternative After-Care subscriber, you qualify for the debt settlement assistance.
Our finance partner can assist with settlement of outstanding debts in order to acquire a clearance certificate. We shall access your repayment profile from the appointed PDA for your outstanding balances. Your financial circumtances shall be assessed to determine how much advance you qualify for to settled your accounts. 

Investigation and Dispute of Unlawful Debt Review - Clearance of Debt Review Flag

* NCRA shall access and supply a Free Credit Report from Xds Credit Bureaus displaying debt counsellor details and status
* We conduct assessment of your debt review cirumstances to establish compliance
* Where it is deemed that you are eligible for debt review dispute and clearance
* You will be requested to complete NCR prescribed dispute documents 
* We log the dispute with the NCR on your behalf in terms of Section 136 Regulation 50 of the NCA. 
* The NCR shall investigate your dispute and resolve the matter within 7 - 30 days
In cases where the debt review circumstances are complex, the removal can take up to 90 days

Alternative After-Care Subscription Options:
Once-Off Annual fee = R1200 or
Annual Subscription = First Month R50 then R120 x 12 months
Short Term Subscription = First Month R50 then R180 x 6 months or
(renewal of subscription service is optional on all packages)    

Affidavit: 
In rare occasions, there are 2 instances where an affidavit might be required. 95% of the cases do not require affidavit.
1. Ncr dispute:
* Where you are certain that you did not apply for debt review
* Where the debt counsellor abandoned the debt review process
* Where it is deemed that the debt review process was not conducted in compliance with prescribed regulations

2. Rescission of Court Order:
* Where Assessment indicates that a court intervention is necessary to resolve your issue.
* When you are certain that you are no longer over-indebted but the debt counsellor refuse to conduct re-assessment of your financial circumstances

PS: Whether you need an affidavit or not shall be determined upon assessment of your entire circumstances and you will be duly informed. 
The affidavit is drafted by an external professional for a fee or R650

  Subscription Registration Options

 Upon confirmation of File Activation, the after-care service process shall commence immediately.
Your Credit Report with details and status of the debt counsellor shall be emailed to you within 60 minutes.
